These Terms of Service govern your use of the Vowtail website and your purchase of products from our store.

Vowtail is a brand and online store operated by an individual seller. In these Terms, “Vowtail,” “we,” “us,” and “our” refer to the seller operating this store and providing the products and services described on this website.

By visiting our website, placing an order, uploading content, approving artwork, or purchasing a product from Vowtail, you agree to these Terms.

These Terms do not limit any rights you may have under applicable consumer protection laws.

Overview

Vowtail creates custom pet portraits, Moment Sets, and personalized keepsakes based on the photos, names, dates, messages, personalization details, and product choices provided by customers.

By placing an order, you confirm that all information you submit is accurate, that you have the right to use any photos or content you upload, and that you understand custom and personalized products are made specifically for your order.

Vowtail may work with independent artists, designers, production partners, fulfillment partners, shipping carriers, and service providers to create, personalize, produce, and deliver your order.

Eligibility

By using our website or placing an order, you confirm that you are at least the age of majority in your jurisdiction, or that you are using the website with the permission and supervision of a parent or legal guardian.

Product Information

We make every reasonable effort to display product images, colors, descriptions, sizes, materials, and prices accurately. However, colors may appear differently depending on your screen, device settings, lighting, materials, printing, painting process, handmade production, or photography.

Hand-painted portraits are artistic interpretations of the photo you provide. Natural variations in brushwork, texture, color, background, proportions, composition, and detail are part of the handmade process and are not considered defects.

Product photos, lifestyle images, mockups, previews, and examples are for reference only. The final product may vary slightly due to personalization, handmade production, materials, lighting, display differences, or natural product variation.

Custom Orders and Customer Responsibility

For custom and personalized products, you are responsible for providing accurate and complete information, including but not limited to:

• Pet photos
• Pet names
• Dates
• Messages
• Phone numbers
• Product options
• Size and style selections
• Shipping address
• Billing information
• Any other personalization details

Vowtail is not responsible for errors, delays, dissatisfaction, or production issues caused by incorrect, incomplete, unclear, low-resolution, or customer-approved information submitted by the customer.

Please review all order details carefully before submitting your order and before approving any artwork, proof, or personalization details.

Photo Uploads and Content Rights

By uploading a photo or other content, you confirm that you own the content or have permission to use it. You also confirm that the content does not violate any law, privacy right, intellectual property right, publicity right, or other rights of another person or entity.

You grant Vowtail a limited, non-exclusive, worldwide license to use the uploaded content for the purpose of processing your order, creating your custom product, communicating with artists, designers, production partners, fulfillment partners, and customer support, and completing your purchase.

This license is limited to what is reasonably necessary to create, process, personalize, produce, fulfill, deliver, and support your order, unless you separately give us permission to use the content for public marketing or promotional purposes.

You agree not to upload content that is unlawful, abusive, offensive, obscene, defamatory, threatening, infringing, invasive of privacy, or otherwise inappropriate.

We reserve the right to refuse, cancel, or request a replacement photo for any order if the submitted content is inappropriate, incomplete, unclear, infringing, low-quality, technically unsuitable, or cannot reasonably be used to create the requested product.

Use of Customer Photos, Reviews, and Testimonials

We will not use private order photos uploaded only for product creation in public marketing unless you have given us permission, submitted the content as a public review or testimonial, tagged or shared the content with us in a way that permits reposting, or otherwise authorized us to use it.

If you submit a review, testimonial, photo, video, or other content for public display, or if you tag or share content with Vowtail for promotional use, you grant us permission to display, reproduce, share, and promote that content on our website, email, social media, advertising, and other marketing channels.

We may make minor formatting adjustments such as cropping, resizing, compressing, or adapting the content for display, but we will not materially change the meaning of your review or testimonial.

If you would like us to remove your review photo, testimonial, or public customer content from future marketing use, please contact us at contact@vowtail.com. We will make reasonable efforts to remove it from future use, although previously printed, published, shared, cached, or distributed materials may not be fully removable.

Order Acceptance

After you place an order, we may review the order details before beginning artwork creation, personalization, production, or fulfillment.

We reserve the right to refuse, cancel, or request changes to an order if the submitted content is inappropriate, incomplete, unclear, fraudulent, infringing, technically unsuitable, unavailable, or cannot reasonably be produced.

An order confirmation email confirms that we have received your order. It does not guarantee acceptance of the order if we later determine that the order cannot be completed.

Prices, Payment, and Errors

Prices are listed on our website and may change at any time without notice. Payment must be completed at checkout before artwork creation, personalization, production, or fulfillment begins.

Taxes, shipping charges, and any applicable fees will be shown at checkout when available.

We reserve the right to correct pricing, typographical, product description, availability, or technical errors. If an error affects your order, we may contact you for confirmation, cancel the affected item, or provide a refund for the affected item as required by applicable law.

Previews, Proofs, and Revisions

Eligible portrait orders may include a preview, proof, or artwork approval process before final production. Revisions are subject to our Revision Policy.

You are responsible for reviewing all previews, proofs, artwork, spelling, names, dates, messages, product options, and personalization details carefully before approval.

Once you approve or finalize a preview, proof, artwork, or personalization detail, you confirm that you have reviewed and accepted it. After approval, the order may enter production and changes may no longer be possible.

Final Approval and Final Sale

For hand-painted portraits, artwork proofs, design proofs, and any order that includes a customer approval step, your approval means you have reviewed and accepted the artwork, design, spelling, personalization details, layout, and overall appearance.

Once artwork creation, personalization, production, fulfillment preparation, or final approval has begun, custom and personalized items are final sale and cannot be canceled, returned, refunded, or exchanged, except where the item arrives damaged, defective, incorrect, or where a remedy is required by applicable law.

This includes, but is not limited to:

• Hand-painted pet portraits
• Custom pet prints
• Moment Sets
• Personalized keepsakes
• Custom name tags
• Custom stickers, puzzles, pillows, socks, cake toppers, magnets, albums, cards, and other photo-based products
• Memorial keepsakes made with your pet’s name, photo, dates, message, fur, paw print, or other personal details
• Any product customized with customer-submitted photos, names, dates, text, design choices, or personalization details

Because these items are made specifically for your order, they cannot be returned, refunded, exchanged, or canceled due to change of mind, personal preference, customer-submitted photo choice, incorrect customer-submitted details, or minor artistic differences.

Shipping and Delivery

Custom artwork and personalized products require production time before shipment. Any production or delivery timelines shown on our website are estimates unless expressly stated otherwise.

We are not responsible for delays caused by shipping carriers, customs processing, weather, holidays, incorrect or incomplete addresses, failed delivery attempts, refusal of delivery, or events outside our reasonable control after an order has shipped.

If we are unable to ship an order within the stated or expected shipping timeframe, we will handle the delay in accordance with applicable law, which may include notifying you of the delay and, where required, giving you the option to accept the delay or cancel the unshipped order.

You are responsible for providing a complete and accurate shipping address. If a package is delayed, returned, lost, or delivered incorrectly because of an incorrect or incomplete address provided by the customer, additional shipping fees may apply, and the order may not be eligible for refund or replacement unless required by applicable law.

International Orders, Customs, Duties, and Taxes

For international orders, you may be responsible for customs duties, import taxes, VAT, brokerage fees, or other charges required by your country or region. These charges are not controlled by Vowtail and may not be included in the product or shipping price unless expressly stated at checkout.

We are not responsible for delays caused by customs processing or a customer’s failure to pay required import charges.

Returns and Refunds

Returns and refunds are governed by our Return & Refund Policy.

Because most Vowtail products are custom-made, personalized, or created from customer-submitted photos and details, they are generally final sale once artwork creation, personalization, production, fulfillment preparation, or final approval has begun.

Nothing in these Terms or our Return & Refund Policy limits any rights you may have under applicable consumer protection laws for damaged, defective, incorrect, or non-conforming goods.

Damaged, Defective, or Incorrect Items

Please inspect your order as soon as it arrives. If your item arrives damaged, defective, or incorrect, please contact us within 7 days of delivery at contact@vowtail.com.

Please include:

• Your order number
• A clear photo of the damaged, defective, or incorrect item
• A photo of the outer packaging and any damaged packaging if the item arrived damaged
• A brief description of the issue

Please keep the item and packaging until your claim has been reviewed.

If your claim is approved, we will provide an appropriate remedy based on the situation and applicable law. This may include a repair, remake, replacement, store credit, partial refund, or refund.

We do not accept unauthorized returns. Please contact us before sending anything back.

Intellectual Property

All content on the Vowtail website, including text, images, graphics, branding, logos, product designs, page layouts, icons, videos, and other design elements, is owned by or licensed to Vowtail and may not be copied, reproduced, modified, distributed, sold, or used without our written permission.

You may not use our name, logo, product images, website content, or branding in a way that suggests endorsement, affiliation, or permission unless we have expressly authorized it.

Website Use

You agree not to misuse our website, interfere with its operation, attempt to gain unauthorized access to any system, use automated scraping or data extraction tools, upload harmful code, commit fraud, violate the rights of others, or use the website for unlawful purposes.

We may restrict or refuse access to our website if we believe a user has violated these Terms or used the website in an inappropriate, harmful, or unlawful way.

Third-Party Services

Our website may rely on third-party platforms, payment processors, shipping carriers, email providers, review tools, analytics tools, advertising platforms, analytics tools, and other service providers. These third parties may have their own terms and privacy practices.

We are not responsible for the acts, omissions, delays, service interruptions, payment processing issues, shipping issues, or policies of third-party providers, except where required by applicable law.

Limitation of Liability

To the fullest extent permitted by law, Vowtail is not liable for indirect, incidental, special, punitive, or consequential damages related to your use of our website, your order, or our products.

To the fullest extent permitted by law, our total liability for any claim related to an order will not exceed the amount paid for that specific order.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

Force Majeure

Vowtail is not responsible for delays or failure to perform caused by events outside our reasonable control, including but not limited to natural disasters, severe weather, carrier delays, customs delays, labor disruptions, supply chain interruptions, technical outages, payment processor issues, government actions, or other unexpected events.

Electronic Communications

By placing an order, uploading content, approving artwork, or contacting us, you agree that we may communicate with you electronically about your order, artwork proof, production updates, shipping updates, customer support, policy notices, and other transaction-related matters.

Marketing communications, if any, will be handled in accordance with applicable law and our Privacy Policy.

Changes to These Terms

We may update these Terms of Service from time to time. The updated version will be posted on this page with the revised effective date.

The version of the Terms in effect at the time you place your order will generally apply to that order, unless a change is required by law or applies to website use after the update.

Severability

If any part of these Terms is found to be invalid, unlawful, or unenforceable, the remaining parts will continue to apply to the fullest extent permitted by law.
